{"id":27792,"date":"2018-01-02T19:30:01","date_gmt":"2018-01-03T00:30:01","guid":{"rendered":"https:\/\/goebt.com\/new-snap-stocking-rules-take-action-now\/"},"modified":"2025-02-04T18:18:41","modified_gmt":"2025-02-04T23:18:41","slug":"new-snap-stocking-rules-take-action-now","status":"publish","type":"post","link":"https:\/\/goebt.com\/new-snap-stocking-rules-take-action-now\/","title":{"rendered":"New SNAP Stocking Rules: Take Action Now"},"content":{"rendered":"<p><strong><em>As we reported before,\u00a0<\/em><\/strong><strong> <a href=\"\/2016-snap-summary-stocking-rule-change-deadline-coming-soon\">SNAP retailer requirements<\/a> <em>have changed, and these changes will impact your c-store in the immediate future<\/em>.\u00a0<\/strong> Per the changes made to the retailer qualifications, the Food and Nutrition Service (FNS) will begin implementing these finalized rules this month.\u00a0 You can view FNS\u2019s <strong><a href=\"https:\/\/www.fns.usda.gov\/snap\/enhancing-retailer-standards-snap-%E2%80%93-stocking-requirements\" rel=\"noopener\">webinar<\/a><\/strong> and download their <strong>one pager<\/strong> for more help preparing for the changes.<\/p>\n<p><!--more--><\/p>\n<p><strong>Beginning January 17, 2018:<\/strong><\/p>\n<ul>\n<li>SNAP retailers must have three (3) varieties of food in <strong>each <\/strong>of the four (4) \u201cstaple food\u201d categories:\n<ul>\n<li>Dairy<\/li>\n<li>Meat, poultry, or fish<\/li>\n<li>Bread or cereal<\/li>\n<li>Vegetables or fruits<\/li>\n<\/ul>\n<\/li>\n<li>SNAP retailers must stock three (3) units of each variety.<\/li>\n<li>At least one (1) item in two (2) of the \u201cstaple food\u201d categories must be perishable (food that will spoil within 2-3 weeks).<\/li>\n<li>The definition of \u201caccessory food\u201d has been updated to include:\n<ul>\n<li>Potato Chips<\/li>\n<li>Cookies<\/li>\n<li>Soda\n<ul>\n<li>You can find the full definition of \u201cAccessory Food Items\u201d as published by FNS <strong>here.<\/strong><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li>Accessory food items are not considered staple foods and are <strong>not<\/strong> counted towards the new stocking requirements.<\/li>\n<li>FNS permits a retailer to demonstrate compliance with the new stocking requirements via receipts or invoices that prove the necessary items were purchased up to 21 days <strong>before<\/strong> the date of an FNS agency inspection.<\/li>\n<\/ul>\n<p>These additional rule implementations are a part of the rule changes that were finalized in 2016.\u00a0 In October 2017, FNS implemented the \u201chot foods\u201d provision of these rule changes that states:<\/p>\n<ul>\n<li>Retailers will be disqualified from the SNAP program if 50% or more of the store\u2019s total gross sales come from foods that are cooked or heated on site (before <strong>or<\/strong> after purchase).<\/li>\n<\/ul>\n<p>The finalized rule states that <strong>eventually<\/strong> SNAP retailers will have to stock seven (7) varieties of food in each of the four (4) staple food categories.\u00a0 However, this provision has been delayed due to the difficulties that will exist for small format stores like convenience stores.\u00a0 Congress requires that FNS change their definition of \u201cvariety\u201d before these rules can take effect.\u00a0 The proposal of this new definition is anticipated some time in this first quarter of 2018.
